2.1. Informational Purposes Only: The tools, calculations, and statistical models provided by A/B Test Pro are for informational and educational purposes only.

2.2. No Warranties: THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. A/B TEST PRO EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

2.3. Accuracy of Models: While we strive to provide useful statistical calculation tools, we do not warrant or guarantee the absolute accuracy, completeness, reliability, or validity of any statistical models, algorithms, or outputs generated by the Service. Variables in real-world testing environments often deviate from theoretical models.

4.1. User Responsibility: You acknowledge and agree that you are solely responsible for any strategic, financial, marketing, or operational decisions you make based on the outputs generated by A/B Test Pro.

4.2. Exclusion of Damages: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL A/B TEST PRO, ITS FOUNDERS, AFFILIATES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES.

4.4. Liability Cap and Non-Excludable Rights: To the maximum extent permitted by law, our total aggregate liability for any claim relating to the Service shall not exceed CAD $100. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for fraud or your non-waivable statutory consumer rights.

5.1. Our Content: The software, source code, user interface, visual design, written guides, and other original content of A/B Test Pro are the exclusive property of A/B Test Pro and are protected by intellectual property laws. The underlying statistical methods are standard, publicly available techniques that we do not claim as proprietary, and which we document openly in our learn guides.

6.1. Local Processing of Inputs: The calculators process your numeric inputs (such as estimated audience sizes, baseline conversion rates, and desired lift) entirely within your browser to generate mathematical outputs. These inputs are not transmitted to, retained by, or stored on our servers.

6.2. No System of Record: The Service is not intended to serve as a system of record for your business metrics; we do not save your calculations between sessions. For details on how we handle data, see our Privacy Policy.

8.1. Governing Law: These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice or conflict of law provision or rule.

8.2. Exclusive Jurisdiction: Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Service shall be instituted exclusively in the courts of the Province of Ontario, located in the City of Toronto. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

8.3. Mandatory Local Law: Nothing in this section deprives you of the protection of the mandatory consumer-protection laws of your country of residence, or of any right to bring proceedings in your local courts where such laws so require.
